How does a home get into court auction sale? The first step in getting a home to an auction sale at the courthouse is to have the lender file a Notice of Default. This is filed after the owner/borrower has missed several payments on his mortgage.
As soon as 90 days after the Notice of Default is filed, the lender can file a Notice of Trustee Sale and then sell the house three weeks later.
Basically, the trustee sale is the final step in the foreclosure process which begins when the bank files a Notice of Default because the borrower is not making payments and ends on the Courthouse steps when either an investor buys the property or the property is sold back to the bank. This is when we purchase the homes in the court system before they go back to the bank and become an REO meaning (real estate owned.)
